Himalayan Tourism - Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the services of Himalayan Tourism ("we," "us," "our," or "Company"). By booking any travel package or service with us, you ("Customer," "you") agree to be bound by these Terms, as well as our Privacy Policy and Refund Policy.
1. Agreement & Services
These Terms govern the relationship between Himalayan Tourism, an Indian travel company, and you, the customer, regarding the booking and provision of domestic and international holiday packages and related travel services ("Services"). We primarily act as an agent for third-party suppliers such as airlines, hotels, transport operators, tour providers, and other principals.
2. Booking and Payments
- Booking Process: Bookings can be made through our website , via email at , or by calling us at . All bookings are subject to availability.
- Deposit: A non-refundable deposit (amount specified at the time of booking) is typically required to secure your reservation.
- Final Payment: Full payment must usually be received by a specified date, often [e.g., 45-60] days prior to departure, or immediately for last-minute bookings. Failure to pay on time may result in cancellation of the booking and forfeiture of the deposit.
- Pricing: Prices quoted are generally per person and are subject to change without notice due to factors like currency fluctuations, fuel surcharges, tax changes, or supplier price increases until full payment is received. We will inform you of any changes as soon as possible.
- Confirmation: Your booking is confirmed only upon receipt of full payment (or deposit as applicable) and issuance of a confirmation invoice or voucher by us. Please check all details carefully upon receipt.
3. Cancellations and Amendments
- By You: If you need to cancel or amend your booking, you must notify us in writing immediately. Cancellation and amendment charges will apply. These typically include charges levied by suppliers (airlines, hotels, etc.) plus our service fee. Please refer to our detailed Refund Policy for more information.
- By Us: While we strive to operate all trips as advertised, we reserve the right to modify or cancel bookings due to unforeseen circumstances or force majeure events. In such cases, we will offer alternative arrangements of comparable standard if available, or a refund as per our Refund Policy and supplier terms.
4. Travel Documents and Health Requirements
- Passports & Visas: You are responsible for ensuring you possess a valid passport (with sufficient validity period for your destination) and any necessary visas, transit visas, or permits for all countries included in your itinerary. We can provide guidance, but obtaining these documents is solely your responsibility.
- Health: You are responsible for checking and complying with all health requirements (e.g., vaccinations, medical certificates) for your destination(s). Consult your doctor or relevant health authorities well in advance.
- Consequences: We are not liable for any costs, delays, or refusal of entry resulting from your failure to possess correct and valid travel documents or meet health requirements.
5. Travel Insurance
- Travel insurance is strongly recommended for all domestic and international trips. It should cover trip cancellation/interruption, medical expenses, emergency repatriation, personal accident, baggage loss/delay, and personal liability.
- Unless explicitly stated as included in your package, you are responsible for arranging your own adequate travel insurance. We can assist in providing options, but the final choice and policy adequacy are your responsibility.
6. Our Liability & Responsibility
- Role as Agent: We act as an agent for third-party suppliers. The services (e.g., flights, accommodation, tours) are provided by these suppliers, and their terms and conditions apply. While we select suppliers with care, we do not control their operations and cannot be held liable for their acts, omissions, errors, or negligence, nor for any loss, injury, damage, delay, or inconvenience caused by them.
- Baggage & Belongings: We are not responsible for loss, theft, or damage to baggage or personal effects during your trip.
- Information Accuracy: We strive to ensure information provided is accurate, but details (e.g., hotel facilities, itinerary timings) may change. We are not liable for minor inaccuracies, especially regarding third-party services.
- Force Majeure: We are not liable for failure to perform or delays caused by events beyond our reasonable control (Force Majeure), including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government restrictions, strikes, or transport failures.
7. Your Responsibilities
- Ensure all information provided to us is accurate.
- Check all travel documents, vouchers, and itineraries upon receipt and report discrepancies immediately.
- Arrive on time for flights, tours, and transfers.
- Behave respectfully towards suppliers, fellow travellers, and local communities.
- Comply with local laws and regulations.
8. Complaints
If you have a complaint during your trip, please inform your tour leader, hotel management, or our local representative immediately so the issue can potentially be resolved on the spot. If the matter is not resolved, please contact us in writing within [e.g., 14-28] days of your return, providing full details. This allows us to investigate properly.
9. Privacy
We are committed to protecting your privacy. Our collection and use of your personal information are governed by our Privacy Policy.
10. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of India.
